User responsibilities, account rules, and usage terms for our infrared spectrum analysis platform.

Service Overview
FTIR.fun provides online spectrum analysis tools and professional spectral interpretation services delivered digitally via a web browser.
User Accounts
Certain features require account registration. Users are responsible for maintaining the confidentiality of their account credentials and all activities conducted under their account.
User Content and Submissions
Users may submit spectra, notes, or other content while using the service.
By submitting content, users warrant that they have the legal right to share such content and that it does not infringe upon any third-party intellectual property rights, confidentiality obligations, or nondisclosure agreements.
Users are expressly prohibited from uploading materials that are confidential, trade-secret protected, subject to non-disclosure agreements (NDA) with third parties, or otherwise legally restricted from sharing, unless they have obtained prior written authorization from the rights holder.
By choosing private analysis, users grant FTIR.fun a non-exclusive license to use, store, and process the submitted content solely to deliver, store, and retrieve the service result. Private content is not used for model training or spectral-library expansion and is not displayed to other users. By choosing free public contribution, users additionally authorize the submitted spectrum to enter the community reference library and to be used for FTIR.fun model training. Content deliberately posted in Public Help Discussion is governed by its separate public data-use notice below.
Public Help Discussion is a separate public submission path. By posting there, users grant FTIR.fun a non-exclusive, worldwide, royalty-free license to display, store, process, index and use the posted content, including spectra, images, notes, sample context and discussion text, for FTIR.fun reference-library retrieval and model training. The posted content is visible to others. Users must have the legal right to share it and must not upload confidential, trade-secret protected, subject to non-disclosure agreements (NDA) with third parties, or otherwise legally restricted data unless they have obtained prior written authorization from the rights holder.
The image-to-spectrum extraction tool is a separate path: spectrum images and extracted curve/CSV data uploaded through this free tool are used to improve the automatic curve-detection model, but they are not used as reference-library records for retrieval. By using the image-extraction tool, you consent to this specific use. If you do not agree, use paid private raw-file analysis instead.
Online Requirement submissions are used by the FTIR.fun technical team to scope and deliver the requested service. The submitted spectra, images, supporting files, sample context, and related information are not used as reference-library records for retrieval or model training. This Online Requirement rule is separate from the public data-use notice for content deliberately posted in Public Help Discussion.
Spectra submitted through the library contribution feature are governed by the separate license you grant on that submission form, which permits FTIR.fun to store, index, and share the contributed data through its services. That feature accepts measured spectral data files only, and requires you to confirm that the data was measured by you or your organization and was not copied, exported, or derived from any commercial or subscription spectral library or database.
Users retain all intellectual property rights to their submitted content. FTIR.fun does not claim ownership of user-submitted materials.
References and Third-Party Content
Reports may include references to published scientific works to support peak interpretation. Such references are limited to objective spectral values and minimal citation information (source, authors, publication, and a short reference sentence). FTIR.fun does not reproduce full texts, redistribute third-party databases, or make protected figures available. FTIR.fun does not claim ownership of, and does not endorse, any third-party work referenced in reports.
Copyright Complaints and Takedown
If you are a rights holder and believe that content available through FTIR.fun infringes your rights, please send a notice to ftir.fun@outlook.com identifying the content, the rights you hold, and your contact details.
Upon receiving a valid notice, we will promptly remove or disable access to the content in question. Where a submitting user is identifiable, we will inform them and allow them to provide a counter-notice; if the counter-notice establishes that the content was lawfully submitted, we may restore it.
Accounts that repeatedly submit infringing content will be suspended or terminated.
Account Responsibilities
Users must promptly notify FTIR.fun of any unauthorized access or security breach affecting their account.
Acceptable Use
Users agree not to engage in any unlawful, abusive, or harmful activities, including submitting malicious code or attempting to disrupt the service.
The following activities are expressly prohibited: reverse engineering, decompiling, or disassembling any portion of the service; scraping, crawling, or employing automated means to extract data in bulk; circumventing rate limits, access controls, or authentication mechanisms; using the service to develop competing products; and reselling or redistributing service outputs without written authorization.
Payments and Fees
Paid plans and usage credits are subject to the pricing displayed on our website at the time of purchase.
All payments are processed through our partners (including PayPro Global). Applicable taxes are calculated by the payment provider at checkout. Where tax-inclusive pricing is supported, taxes are included in the displayed price; where required by law, taxes may be added.
Service Availability
FTIR.fun aims to provide reliable service but does not guarantee uninterrupted availability. We reserve the right to perform maintenance, updates, or modifications as needed.
We do not guarantee that the service will be error-free, secure, or fit for a particular purpose beyond what is expressly stated.
Intellectual Property
The service, its code, design, and content (excluding user-submitted data) are owned by FTIR.fun or its licensors. Users may not reproduce, modify, or distribute FTIR.fun-branded materials without permission.
Disclaimer of Warranties
FTIR.fun is provided 'as is' without any express or implied warranties, including but not limited to merchantability or fitness for a particular purpose.
FTIR.fun reports and conclusions apply AI-assisted analysis and are intended for research and technical evaluation only. They are not suitable as legally conclusive evidence and must not be used in forensic identification or equivalent proceedings.
Limitation of Liability
To the maximum extent permitted by law, FTIR.fun's liability is limited to the amount paid by the user in the 12 months preceding the claim.
Termination
Users may terminate their account at any time by contacting us. FTIR.fun may suspend or terminate accounts for violations of these terms.
Governing Law
These terms are governed by applicable laws. Any disputes shall be resolved through negotiation or as required by applicable consumer protection regulations.
These terms and the declarations on our submission forms are written in English and translated into other languages for convenience. If a translation differs from the English text, the English text governs, except where applicable consumer protection law requires otherwise.
