FTIR.fun is an independent analytical platform providing spectrum analysis tools, reference data aggregation, and interpretation assistance.

Reference Database — Data Sources & Legal Status

The FTIR.fun reference database is a continuously evolving resource intended to support scientific research, technical interpretation, and preliminary analytical evaluation.

Reference spectra are compiled from three categories:

• Experimental data measured by the founding team over decades of professional infrared spectroscopy practice.
• Spectra and technical materials contributed by users through a separate contribution or licensing process with explicit permission.
• Objective spectral measurements obtained from public-domain materials or from openly licensed scientific data sources used under their stated terms.

Reference spectra are compiled from in-house measurements, explicitly authorized user contributions, and factual data extracted from public-domain sources under applicable copyright law.

We do not use commercial spectral libraries (e.g., subscription databases) as data sources, and we do not redistribute any third-party database.

To improve peak-assignment accuracy, the platform consults public scholarly indexing metadata (bibliographic records and abstracts made openly available by academic indexing services and open-access publishers under their own terms). This metadata is factual bibliographic information. Reports contain only objective spectral values and minimal citations — never full-text reproduction, never wholesale copying of any work, and never redistribution of any third-party database.

Copyright, Open Licenses & Database Rights

FTIR.fun distinguishes objective spectral measurements from protected expressive presentation and from rights that may subsist in a database as a collection. Public availability is not treated as an open license, and each source is assessed under the law and license terms that apply to it.

The legal framework considered includes the Berne Convention, the WTO TRIPS Agreement, United States copyright principles reflected in Feist Publications, Inc. v. Rural Telephone Service Co. (499 U.S. 340, 1991), China's Copyright Law, and, where applicable, database rights such as those provided by Directive 96/9/EC in the European Union.

For third-party datasets released under an open license, FTIR.fun follows the license attached to the source. Where a source actually uses terms such as CC BY or CC0, the corresponding attribution, reuse, and other license conditions are followed. An item being publicly viewable on the internet is not by itself treated as permission for unrestricted reuse.

Reference information provided by FTIR.fun should not be considered authoritative identification and should not be used as the sole or direct basis for arbitration, regulatory decisions, conformity assessment, or accredited laboratory conclusions. Some entries may carry less sample-preparation metadata than mature commercial databases.

Users are responsible for independently verifying analytical results. Curated reference spectra enter the reference database only through a separate contribution or licensing process with explicit permission. Public Help Discussion content is a separate public retrieval and training source, not the same as a curated Add Spectrum record; confidentiality and zero-retention plans remain outside both sharing paths.

Non-Substitution Disclaimer

FTIR.fun is designed to complement, not replace, proprietary or vendor-provided spectral libraries, regulatory databases, or certified reference materials.

Reports and conclusions generated by the platform apply AI-assisted analysis and are intended for research and technical evaluation only. They are not suitable as legally conclusive evidence and must not be used in forensic identification or equivalent proceedings.

Institutional Use Considerations

Institutions remain responsible for ensuring compliance with their internal data governance, confidentiality policies, and regulatory obligations when using this service.

Users should not upload confidential, restricted, or contractually protected data unless explicitly authorized.

Data Privacy Pledge

The standard analysis workflow routes free-user searches to public contribution and paid-user searches to private analysis. Public contributions enter the community reference library and may be used for FTIR.fun model training. Paid private analyses are used solely to deliver, store, and retrieve the service result; they are not used for model training or spectral-library expansion and are not displayed to other users.

Online Requirement submissions are another separate service-delivery path. Spectra, images, supporting files, sample context, and related information submitted through Online Requirement are handled by the FTIR.fun technical team to deliver the requested service, and are not used as reference-library records for retrieval or model training.

Public Help Discussion is a separate public data-use path. Content posted there, including spectra, images, notes, sample context and discussion text, is visible to others and will be used for FTIR.fun reference-library retrieval and model training. Users must have the legal right to share it and must not upload confidential, trade-secret protected, subject to non-disclosure agreements (NDA) with third parties, or otherwise legally restricted data unless explicitly authorized by the rights holder.

Institutional and enterprise data under zero-retention plans is permanently deleted after report delivery as specified in the applicable agreement.

The image-to-spectrum extraction tool is another separate data-use path: spectrum images and extracted curve/CSV data uploaded through that free tool are used to improve the automatic curve-detection model that powers it, as disclosed on the tool page, but they are not used as reference-library records for retrieval. Institutional customers using the image-extraction tool should ensure their uploads are permitted for this purpose. Paid private raw-file analyses are not used for training.

No Warranty or Certification

FTIR.fun does not provide certified analytical results, regulatory approvals, or legally binding conclusions.

All interpretations and comparisons are provided without warranty and should be independently verified where required.
